Understanding West Virginia’s wrongful death statute

West Virginia allows the family of a deceased person to bring a wrongful death lawsuit in any situation where the deceased could have brought a personal injury lawsuit had the injuries not been fatal. Typically, accidental death claims are pursued in relation to fatal car accidents, deadly medical malpractice and fatal falls. Some of the most important points of the law are:

  • Parties allowed to bring a claim. Only the personal representative of the decedent (deceased person) may bring a wrongful death claim. This person is usually the executor of the will or the administrator of the estate. Damages recovered in the suit will be split between close family members and other dependents.
  • Damages. The jury can award any damages they think are fair. Typically, this includes compensation for anguish, sorrow, solace, loss of income, medical expenses and burial costs. The jury can award money for other reasons as well and can also choose the amounts which each family member will receive.
  • Time limits. A wrongful death action must be brought within two years of the date of death to comply with West Virginia’s statute of limitations.
